The Individuals with Disabilities Education Act (IDEA) and the Family Educational Rights and Privacy Act (FERPA) require education agencies to provide written notification and obtain parent/guardian consent before disclosing information about a student to access Medicaid reimbursement. Written notification must be provided to parent/guardian annually thereafter. The Oregon Department of Education provides templates for both written notification and parent/guardian consent for Early Intervention (EI), Early Childhood Special Education (ECSE), and School Age programs.
