The deadline for the Certificate Holder (Madras PV1, LLC, a wholly owned subsidiary of Ecoplexus Inc.) to commence construction was June 25, 2024. The certificate holder must complete construction of the facility within 18-months of the construction commencement date.
On June 25, 2024, the Department received the preliminary Request for Amendment 1 (pRFA1), inclusive of an Amendment Determination Request, Type B Review (ADR), seeking Council approval to extend the construction commencement deadline from June 25, 2024 to June 25, 2027; extending the construction completion deadline by 18 months from the new construction start deadline. Following review and completeness determination, the certificate holder submitted a complete Request for Amendment 1 (RFA1) on October 17, 2024.
On October 18, 2024, the Department issued a Draft Proposed Order (DPO) on RFA1, and a Public Notice requesting public comment on RFA1 and the DPO. A Public Hearing on the Draft Proposed Order was held virtually and in person in Madras, OR at the November 14, 2024 Energy Facility Siting Council meeting.
At the November 14 Council meeting, a public comment period extension was requested and granted, extending the deadline for public comments on the DPO and RFA1 to December 5, 2024 and 5:00 p.m. Pacific Time. All comments received, and the certificate holder's responses to public comments can be viewed on the Department's Siting Docket.
On January 30, 2024 the Department issued the Proposed Order. On the same date the Department issued a Public Notice of the Proposed Order and Opportunity to Request a Contested Case. These documents are available below.
The Proposed Order includes changes from the DPO based on comments received during the DPO comment period, certificate holder responses to comments, and Council's review of the DPO. All changes from the DPO to Proposed Order are presented in “red-line" format to track the changes. The Proposed Order recommends Council approve the request and grant issuance of an amended site certificate, subject to conditions recommended in the Proposed Order.
Only those who commented on the record of the DPO were eligible to request a Contested Case. The deadline to request a Contested Case is March 3, 2025 at 5 p.m. Pacific Time.
Council will review the Proposed Order and any eligible requests for a Contested Case at the March 20-21, 2025 EFSC meeting.
