The Coronavirus Aid, Relief, and Economic Security Act, 2020 (CARES Act) includes a provision for assistance to non-public schools, also known as equitable services. This provision applies to both ESSER and GEER funds within the CARES Act. Under this provision, any local education agency (LEA) receiving funds under ESSER or GEER are required to provide services to students and teachers in the same manner as under section 1117 of the Elementary and Secondary Education Act (ESEA) of 1965. LEAs are required to consult with representatives of non-public schools to determine equitable share.
Note: Equitable Services under the CARES Act is separate from the
Emergency Assistance for Non-Public Schools (EANS) Program under GEER II of the CRRSA Act.
