OHA testing rules
All hemp commodities or products used for human consumption - eating/drinking, smoking, or applications to skin/hair - must be tested to the same standards as marijuana as established by the the Oregon Health Authority (OHA). New Hemp Vendor License
Starting July 1, 2024:
In Oregon, any hemp retailers or wholesalers who store, transfer, or sell industrial hemp or hemp items for resale to another person must get a hemp vendor license from the Oregon Department of Agriculture (ODA), as per
OAR 603-048-0175. The vendor license costs $100 per year and is valid from July 1 – June 30. This schedule aligns with ODA's Food Safety and Weights and Measures licensing cycle, making it easier for customers who need multiple licenses to do business with ODA.
Hemp Item Specific Information
HB 3000, 2021 Oregon Legislature, created some over lapping laws for hemp items between the Oregon Liquor and Cannabis Commission (OLCC) and ODA. The over lapping laws are around:
- sales to minors,
- use of synthetic (or lab-created) cannabinoids,
- amount of THC allowed in all products, and
- packaging and labeling requirements for hemp vape products.

These changes impact any business that sells cannabinoid hemp and CBD products to Oregon consumers, except for OLCC-licensed marijuana retailers. This includes grocery and convenience stores, smoke shops, and CBD stores in Oregon, as well as online vendors selling to Oregon consumers.
Federal Hemp Program
The Agriculture Improvement Act of 2018 (2018 Farm Bill, Section 10113) directs the US Department of Agriculture (USDA) to issue regulations and guidance to implement a program for the commercial production of industrial hemp in the United States.
