Instructions: Permit Application for Commingled Recycling Permit Facility

Introduction

Oregon Revised Statues 459A.955 requires that CRPFs apply to DEQ for a solid waste disposal permit prior to establishing or starting operations. CRPFs possessing an active solid waste disposal site permit and in operation before July 1, 2025, that submit a complete CRPF permit application by Feb. 1, 2025, may continue in operation pending a determination by the department and issuance of a disposal site permit.

The following documentation and information must be submitted in writing to DEQ in order for the permit application to be complete. A complete application should include the following items.

  • A completed and signed Permit Application 
  • A complete operations plan
  • Any other information DEQ deems necessary​

The following documentation and information must be submitted in writing to DEQ in order for the permit application to be complete. A complete application should include the following items.

New or proposed CRPF facilities must include Design and Construction Plans for the facility. These plans are used to describe the location and physical features of the facility, as well as address specific details about the facility. These details can be illustrated with a map and in writing. Additional details to be contained in each plan are described below.

These types of plans are used to describe in detail what you intend to construct at your facility.
Construction cannot begin until the Department has approved the plans. Once approved, the Department must approve of any modifications.

Plans and specifications for a commingled recycling processing facility shall include, but not be limited to:

  • The location and physical features of the facility.
  • Contours, surface drainage control, access and on-site roads.
  • Fire Protection measures.
  • Traffic routing, landscaping, weigh stations, and fences.
  • Specifications for solid waste handling equipment.
  • Truck and area washing facilities and wash water disposal.
  • Water supply and sanitary waste disposal.​

Obtaining a Commingled Recycling Processing Facility Permit

According to DEQ rules, a CRPF is considered a solid waste disposal site. CRPFs must submit a new application or a modification for a solid waste disposal site; applicants should check the “CRPF" box. DEQ will process the complete application, conduct a site and facility visit, conduct a public comment period on the drafted permit and issue the permit, barring a complicating issue. The table below outlines the permitting process and includes links to necessary application materials. 

Step 1 - Application

Operator of proposed CRPF facility gathers information and submits a complete application to DEQ.

Step 2 - Completeness review

Application is received and reviewed for completeness; DEQ permit writers work with the applicant to obtain complete application

Step 3 - Site and Facility Visit

DEQ permit writer conducts a site and facility visit to observe facility's operations and obtain complete information about the facility.

Step 4 - Draft permit and applicant review

DEQ permit writer drafts permit and permit evaluation report and shares the drafts with the facility for applicant review.

Step 5 - Public notice

DEQ permit writer drafts public notice document and cover letter and puts the draft out for a 30 or 35-day public notice period. This includes the draft permit, permit evaluation report, public comment and a public hearing (as applicable).

Step 5 - Comment period ends

DEQ permit writer responds to comments, alters permit as necessary and issues the permit.

Step 6 - Length of time to issue a CRPF permit

Once DEQ receives a complete application (all required application materials) it takes roughly four to six months to issue a CRPF permit. Complex permits may take longer to issue.​
