In July 2023, the Environmental
Quality Commission, DEQ’s governing body, adopted rules for the Diesel
Emissions Identification Program in the newly created
division
269 of
the Oregon Administrative Rules. The program fulfills the requirement to create
a voluntary emissions control program for nonroad construction equipment that
the legislature directed DEQ to implement with HB 2007 (2019) as a part of a
larger strategy to reduce diesel emissions in the state of Oregon.
This program will provide emission
control labels for nonroad construction equipment, like excavators and loaders.
This rule uses DEQ’s existing authority for adding emission control labels for
onroad concrete mixer trucks and dump trucks. These labels can be used to help
track fleet compositions for construction projects which can be useful in
demonstrating compliance with clean construction contracting standards that
other government agencies may have, in addition to clean construction
requirements that other entities may have.
