ORS 431A.218 (2) states that Local Public Health Authorities (LPHAs) may administer and enforce standards established by state laws or rules regarding regulating the retail sale of tobacco products and inhalant delivery systems. This includes conducting outreach and education about tobacco retail licensing within their community. Through local education and outreach activities, LPHAs can engage with community members, build and maintain relationships with retailers, and help enforce tobacco retail licensing state and federal laws. Program Element 76 (Tobacco Retail Licensing), as approved by the Coalition of Local Health Officials, allows interested LPHAs to inspect tobacco retailers in their communities on behalf of OHA. Starting July 2023, LPHAs that opted into Program Element 76 can inspect retailers for compliance with Oregon's tobacco retail sales laws. LPHAs will have an annual window to opt into the Program Element.
