Aboveground Storage Tanks

The Office of the State Fire Marshal has primary responsibility for regulating and tracking aboveground storage tanks in Oregon. DEQ has not adopted rules regarding the installation or removal of ASTs storing petroleum or listed hazardous substances.

DEQ regulations do affect ASTs when

Transferring 10,000 gallons or more of petroleum or liquefied natural gas from a facility or a vessel over waters of the state. You must have a DEQ-approved spill contingency plan.
You have spilled or released a reportable quantity of petroleum or hazardous substances from ASTs. You must report to DEQ's Emergency Response Program.
Dispensing gasoline from ASTs. You may need to obtain an Air Contaminant Discharge Permit.
Installing a new tank. You may need to submit a Notice of Intent to Construct Application.

In addition, EPA's Spill Prevention, Control and Countermeasure Rule regulates certain ASTs.
