DEQ has revised Total Maximum Daily Loads, or TMDLs, to address temperature impairments in the Lower Columbia-Sandy Subbasin and Willamette Subbasins with public participation. These TMDLs were issued by DEQ and approved by EPA between 2004 and 2010. DEQ is under a court order to update and replace these temperature TMDLs to make them consistent with the current temperature standards. These TMDLs must be updated because they were based in part on the Natural Conditions Criterion, a section of the temperature standard that was subject to litigation and has since been disapproved by EPA. Staff provided informational updates to the commission at the April 2022, May 2022, March 2023, and July 2023 meetings. At this special EQC meeting, DEQ will request the commission adopt these TMDLs by reference, into rule.

Item B: 2025-27 Agency Request Budget Certification (Action) DEQ will present a summary of the 2025-27 Agency Request Budget for the commission's final review and request approval for the EQC Chair to certify the budget submittal.

Item C:
Contested Cases Overview (Informational) EQC Counsel and DEQ's Manager of the Office of Compliance and Enforcement will provide an overview about the contested case process, EQC's role in that process, the types of materials that come before the EQC in a contested case, and the relevant authorities. There are three contested cases coming before the EQC in the fall of 2024. This item is to help the commission prepare for that work, but the specifics of the three cases will not be discussed during this item.
