Welcome and meeting open
The commission will open the meeting and review the day’s agenda.

9:40 a.m.
Item A: Draft meeting minutes (Action)
Commissioners will review and take action on proposed draft minutes from recent EQC meetings.
9:45 a.m.
DEQ will present written and verbal updates on agency activities and other issues of interest to the commission. Item to include the annual public service awards recognition and introduction of DEQ’s Interim Deputy Director.

10:45 a.m.
DEQ will provide updates on the 2023 Legislative Session, including bills under consideration, and DEQ’s budget process.  
 
11:15 a.m.
DEQ will provide updates regarding a rulemaking under development for seismic stability, as directed in legislation regarding fuel tank seismic stability requirements. The commission will be asked to take action on a proposed rulemaking later in 2023.

Item E has been postponed to a future EQC meeting.

12 p.m.
Working lunch and executive session
The commission will hold an executive session over a working lunch, pursuant to ORS 192.660(2)(f) and (h).
 
1:30 p.m.
DEQ and the Department of Fish and Wildlife will present updates regarding the rulemaking under development for Fish and Aquatic Life Use.

Item G: Environmental Quality, and Fish and Wildlife Cross-commission conversation 
The Environmental Quality Commission will meet with members of the Fish and Wildlife Commission to discuss items of mutual interest and opportunities to partner in work moving forward.

Item H: Public forum
The commission will hold a comment opportunity for any environmental and public health issues relevant to DEQ and EQC. Sign-ups to comment will occur at the start of this agenda item, and people are asked to limit comments to three minutes or less. Comment times may be reduced at the discretion of the commission if needed.

DEQ will present an informational update on the Powder Basin TMDL rulemaking process. 

9:35 a.m.
DEQ proposes that the Commission delegate to the Director the authority to adjust certain Water Quality fees by up to 3% following the normal rulemaking process. 
 
9:45 a.m.
Item K: Commissioner reports (Informational)
Commissioners will provide verbal updates of their recent activities of interest to DEQ and EQC.

10 a.m. Break 

10:15 a.m.
DEQ will present a brief informational overview of efforts and coordination related to wildfire recovery. Some of these efforts will require EQC review and action under the 3 Basin Rule. DEQ staff will provide an overview of these requirements and the process it is planning to use.
