Out-of-State Legal Counsel
To make legal arguments or sign certain documents in Oregon Public Utility Commission (PUC) proceedings, an attorney must be in good standing with the Oregon State Bar, or affiliate with an attorney in good standing, to appear pro hac vice. A motion to appear pro hac vice before the PUC must contain the following:
1. A certificate of compliance.
2. A certificate of good standing from the jurisdiction the attorney regularly practices.
3. A certificate of insurance covering activities in Oregon and professional liability insurance equal to the Oregon State Bar Professional Liability Fund Plan if the attorney’s appearance constitutes the private practice of law and related statutes.
4. A statement demonstrating the attorney is associated with a member of the Oregon State Bar identified in the PUC service list who will “participate meaningfully in the matter.”
Motions to appear pro hac vice are made on a case-by-case basis. Each application is good for one attorney, per case, per year. Additional guidance available.
