The Oregon Legislature passed HB 2970 (2021), which changed the scope of practice for estheticians and advanced estheticians. The legislature charged the Board of Certified Advanced Estheticians and the Board of Cosmetology to work collaboratively to define the term “device" as it relates to each profession. Based on the legislative requirement, a Joint Rules Advisory Committee was assembled to make recommendations to both boards. As a result of those recommendations, both boards met on June 12, 2023, and approved proposed rules defining an esthetics device, natural physiological effects, and defining an advanced esthetics device.
The Health Licensing Office (HLO), the Board of Cosmetology, and the Board of Certified Advanced Estheticians intended to file a Notice of Proposed Rulemaking (Notice) with the Secretary of State for publication in the August 1, 2023, Oregon Bulletin, but time constraints did not allow HLO to do so.
In 2021, the Health Licensing Office (HLO) convened a Joint Esthetic and Advanced Esthetic Rules Advisory Committee (Joint RAC) to collaborate and recommend rule changes to the Board of Cosmetology (COS Board) and the Board of Certified Advanced Estheticians (CAE Board), including defining the term “device" within both the advanced esthetics and esthetics professions as required in HB 2970 (2021).
The Board of Cosmetology and Board of Certified Advanced Estheticians reconvened an Esthetics and Advanced Esthetics Joint Rules Advisory Committee (Joint RAC) which met on January 30, 2023, to continue discussion regarding the requirements of HB 2970 (2021) related to collaboratively defining the term “device" within both the esthetics and advanced esthetics professions.
Currently, the Joint RAC has meetings scheduled for February 27, 2023, and March 27, 2023. The Health Licensing Office (HLO) will be canceling the February 27, 2023, meeting due to other time sensitive obligations and to allow adequate time to develop and research information on devices. The HLO still intends to hold its March 27, 2023, meeting from 9 a.m. to 1 p.m. Further decisions will be made on scheduling additional RAC meetings following the March 27, 2023, meeting.
2021 Rules Advisory Committees Summaries
