The OSH Rulemaking Process

The process to adopt, amend, repeal or suspend an Oregon Administrative Rule has many steps and takes months to complete.  The rulemaking process includes 2 types of public meetings at OSH: Rules Advisory Meetings and Rulemaking Hearings.

Rules Advisory Committee (RAC) meetings are an opportunity for external experts, businesses and other stakeholders to give input to OHA about proposed rulemaking. RAC members have the opportunity to review and comment on proposed rules and Oregon State Hospital's Statement of Need and Fiscal Impact. The RAC’s role is advisory and consensus is not necessary.

RAC meetings are public meetings and any individual is welcome to attend, observe and listen. However, only those specifically invited to be a member of the committee may participate fully in the meeting. RAC meetings may include time for the public to provide comment.

After the RAC meeting ends, Oregon State Hospital (OSH) will discuss and thoughtfully consider all suggestions and concerns expressed by RAC members and the public. Then OSH will finalize the proposed text and submit a notice of rulemaking or notice of hearing to the Secretary of State. The public will have the opportunity to review and comment on the proposed rules as required by statute. Comments received during this period may affect the final text of the rule.

After Oregon State Hospital (OSH) finalizes the proposed text of an Oregon Administrative Rule (OAR) and submits a notice of rulemaking or notice of hearing to the Secretary of State, the public has the opportunity to review and comment on the proposed rules as required by statute. Comments received during this period may affect the final text of the rule. After fully considering all written and oral comments, OSH will file an adopted, amended or repealed permanent rule with the Oregon Secretary of State.
