What is the Reproductive Health Program?

The Oregon Reproductive Health (RH) Program receives funding from three different sources to provide reproductive health services to people in Oregon. It is dedicated to ensuring all people in Oregon have access to high-quality, culturally-responsive reproductive and sexual health services, knowledge, and resources through partnerships with clinics, community organizations, and policy makers.

The RH Program commits to working towards racial equity by addressing racism and implicit bias, and reducing systemic barriers to care. We acknowledge the past and present role of government in creating inequities and doing harm to communities of color and tribal and indigenous communities in Oregon, leading to historical and ongoing trauma. Notice of Proposed Rulemaking for OAR 333-004

The Oregon Health Authority, Public Health Division, Center for Prevention and Health Promotion, Oregon Reproductive Health Program is proposing permanent amendments to OAR chapter 333, division 4. As outlined in the 2023 Special Terms and Conditions (STCs) for the state's 1115 family planning Medicaid demonstration waiver, Oregon ContraceptiveCare (CCare), the Reproductive Health (RH) Program is required by the Centers for Medicare and Medicaid Services (CMS) to provide coverage for non-emergent medical transportation (NEMT) for individuals eligible for and enrolled in CCare as of January 1, 2025. To ensure parity in benefits across all funding streams that make up Reproductive Health Access Fund (RHAF) coverage, the RH Program is extending NEMT coverage to all RHAF enrollees. Concurrent with this rulemaking, the Oregon Health Authority will be amending OAR 410-136 'Medical Transportation Services' to include NEMT coverage for RHAF enrollees. Also outlined in the 2023 STCs is approval by CMS to provide CCare enrollees with 2-year continuous eligibility instead of 1-year. The RH Program implemented this change for all RHAF enrollees June 1, 2024. 

The RH Program is also amending rules to:

  • allow for up to two Reproductive Health Coordinators per agency;
  • provide additional clarity regarding Reproductive Health Equity Act (RHEA) covered services;
  • clarify billing and coding guidance for agencies;
  • clarify that agencies must assume responsibility for the cost of any services provided to an enrollee if the agency failed to inform the enrollee of the cost of such services prior to providing them; and
  • describe RH Program audit and payment recovery processes related to compliance with client eligibility and enrollment requirements.

You are invited to review and comment on the proposed rules. There are two (2) options to provide comment:

What is RHCare?

RHCare is a program that uses all three funding sources to provide reproductive health services to anyone with reproductive capacity. RHCare clinics receive reimbursement for reproductive health services provided to clients enrolled in the RH Access Fund.

Although RHCare does provide reimbursement, it is not just a coverage source. The RH Program believes that all people are entitled to high-quality, culturally-responsive reproductive health services. Therefore, RHCare clinics are required to provide the same high-quality, culturally-responsive reproductive health services to all clients with reproductive capacity, regardless of ability to pay.

How to Become a RHCare Clinic 

To become a RHCare clinic(s), agencies must meet the RHCare Certification Requirements and complete an Application for Certification. The Certification Requirements provide the foundation for high-quality services based on national standards of care and align with best practices and recommendations for
comprehensive client-centered, culturally-responsive preventive care. RHCare clinics must also be enrolled in the Oregon Health Plan OHP, offer the same services to OHP clients, and bill OHP.

What is CCare?

The Oregon ContraceptiveCare Program (CCare) is a program that uses Medicaid waiver funding to provide services related to preventing pregnancy to a subset of clients enrolled in the RH Access Fund. CCare clinics receive reimbursement for CCare services provided to clients enrolled in the RH Access Fund who qualify for CCare funding.

To become a CCare clinic(s), agencies must meet the CCare Certification
Requirements and complete an Application for Certification. The Certification Requirements provide the foundation for high-quality services based on national standards of care and align with best practices and recommendations for
comprehensive client-centered, culturally-responsive preventive care. CCare clinics 
must also be enrolled in the Oregon Health Plan OHP, offer the same services to OHP clients, and bill OHP.

Annual CCare Post-Award Forum
On May 14th, 2024, the Reproductive Health Program, as outlined in 42 CFR 431.420(c), will hold a post-award forum to solicit comments on the progress of its 1115 family planning demonstration waiver Oregon ContraceptiveCare (CCare). The 2023 Annual Monitoring Report is available here. Members of the public may provide comments regarding CCare on May 14th from 3:00 to 4:00 through Microsoft Teams (click here to join the meeting) or by phone at 971-277-2343, phone conference ID: 452 481 083#. Comments or questions may also be directed to the RH Program in writing, on or before May 14th at rh.program@oha.oregon.gov

What is AbortionCare?

AbortionCare is a program that uses Reproductive Health Equity Act (RHEA) funding to provide abortion services and post-procedure contraceptives to a subset of clients enrolled in the RH Access Fund. AbortionCare clinics receive reimbursement for AbortionCare services provided to clients enrolled in the RH Access Fund who qualify for RHEA funding.
