Rulemaking


Oregon Administrative Rules (OARs) determine how the Oregon Department of Emergency Management and other state agencies operate, including how they interpret and implement state laws. ORS 183.310(9) defines "rule" as any agency directive, standard, regulation or statement of general applicability that implements, interprets or prescribes law or policy, or describes the procedure or practice requirements of any agency.

Rules may be adopted, amended, repealed, suspended, or renumbered through a process known as rulemaking. During this process, the public is encouraged to provide feedback on proposed rules to ensure they are fair and effective. After a proposed rule has been approved and filed with the Secretary of State, that rule becomes adopted.

Public Participation in Rulemaking


OEM offers several opportunities for people and organizations to provide feedback on proposed rulemaking.


One way OEM receives input is through rulemaking advisory committees (RACs). These committees gather representatives with specialized knowledge or interest on a particular topic to shape rule language and incorporate public input into proposed rules.​

OEM creates RACs for large or complex topics. RAC members are chosen from among subject matter experts and stakeholder groups, such as other government agencies and professional associations.

RACs gather technical information and consider environmental and social concerns. They research the fiscal impact of rules and determine their impacts on businesses. A RAC will help inform the way OEM writes a proposed rule.

After the RAC concludes its work, when rulemaking proposals are made, OEM will provide a notice of proposed rulemaking, schedule a rulemaking hearing, and invite members of the public to testify at the hearing or to submit written comments. OEM will use input gathered at the hearing to write the final version of the rule that will be published. ​​
