A Transfer Extension of Time is a process in which the Department can approve additional time for a transfer holder of record to perfect the beneficial use of water as authorized by the final order approving a transfer. A Transfer Extension of Time may be approved, provided reasonable diligence can be found toward development of the beneficial use of water as authorized under the transfer final order. Transfer Extensions are granted for one year, from October 1 to October 1 of each year. An extension for up to five years may be granted for transfers involving municipal or quasi-municipal use. Extensions for transfers may be granted for a longer time if the applicant can justify the need for a longer period of time by submission of pertinent evidence. Each application is reviewed on a case-by-case basis.
When a change of ownership or interest occurs in lands described by a transfer application or by a final order approving a transfer, the current record holder or a new owner may request the director to record an “Assignment" of the transfer to the new owner.
