The Department has created a standard form to amend a Surface Water Registration (SWR) Statement. However no SWR Statement or amendment to a SWR Statement shall be construed as a final determination until adjudicated under the provisions of ORS 539.010 to 539.240.
Amendments to Surface Water Registrations may be submitted to:
- Change the ownership of a SWR
- Change the location of a point of diversion (POD)
- Add a POD (on the same source)
- Change the location of the place of use
- Change the character of use
A SWR amendment must:
- Be submitted on the Department's form;
- Include documentation that water has been used during the last five years;
- Include a request stating the reason for the change or addition; and
- Provide proof of ownership if requesting an ownership change.
The Department will review each amendment to determine that the change will not result in injury to other water users or a net loss to water available downstream users, nor result in an expansion under the original SWR. The Department will review the amendment for completeness and then place the information on the Department’s weekly public notice.
