How to Submit an Exclusion Appeal to OPRD

If you have received an exclusion from Oregon Parks and Recreation Department (OPRD) and believe it to be unjust, you have the right to appeal the decision. Follow the steps below to submit an appeal.

Step 1: Review the Exclusion Notice

  • When you receive an Exclusion Notice, carefully review the details, including the reason for the exclusion and the time period.
  • The notice will include information about your right to appeal and instructions on how to submit your appeal.

Step 2: Prepare Your Appeal Submission

To submit a valid appeal, you will need to provide the following information:

  1. Statement for the Basis of Appeal: Explain why you believe the exclusion is unjust or should be modified. This can include new evidence or circumstances not considered in the original decision.
  2. Exclusion Notice Number: Include the specific number of the exclusion notice you received.
  3. Contact Information: Provide your current contact details, including:
    • Full name
    • Phone number
    • Email address
    • Mailing address

Note: Make sure all required information is included to avoid delays in processing your appeal.

Step 3: Submit Your Appeal

You can submit your appeal through any of the following methods.

  • By Mail: Send your appeal to:
    • Oregon Parks and Recreation Department
    • Exclusion Appeal

    • Salem, OR 97301
  • By Phone: Call (866) 759-4580 initiate the appeal process.
  • By Email: Send your appeal to exclusion.appeal@oprd.oregon.gov.

Please Note: Submissions will be reviewed only if all required information is provided. Incomplete submissions will cause delays.

Step 4: Confirmation of Appeal Submission

  • Upon receiving your appeal, the Exclusion Appeals Coordinator will send you a confirmation receipt within 3 business days.
  • If your appeal is missing any required information, we will reach out via the contact information you provide to request the necessary details.

Step 5: Review of Your Appeal

  • Once your appeal is submitted, we will review all provided information.
  • The official response to your appeal decision will be sent within 30 calendar days.
  • Please note that the 30-day timeline begins only once all required appeal information has been received. If additional information is needed, there may be a delay in the review process.

In-person or Online Review Request:

  • The individual may request an in-person or online review meeting during the appeal process.
  • Requests for in-person meetings will be reviewed on a case-by-case basis, and reasonable accommodations will be considered by the Exclusion Appeals Coordinator.
  • In-person review meetings may be conducted in a neutral location, with law enforcement support if necessary.
  • The panel does not need to make decisions or deliberations during this review meeting.
  • Panel members are not required to be in-person during an in-person review meeting.

Note: During the appeal process, the exclusion will remain in effect unless explicitly suspended.

Step 7: Special Circumstances During the Appeal Process

  • Suspension of Exclusion: You may request that your exclusion be suspended during the appeal process under certain circumstances, such as if the exclusion involves expressive conduct (e.g., picketing, demonstrating) or involuntary actions.
  • In-person Appeal Reviews: If requested, an in-person or online meeting may be arranged to discuss the appeal.

Step 8: Additional Information

All appeals and their documentation will be processed by the Exclusion Appeals Coordinator and tracked in OPRD’s system for transparency and record-keeping.

  • The Exclusion Appeals Coordinator is responsible for coordinating all logistics between the person appealing and OPRD's review panel. This includes facilitating communication, scheduling meetings, and ensuring all necessary documentation is provided.
  • However, the Exclusion Appeals Coordinator is not involved in the decision-making process of the appeal. The coordinator’s role is strictly administrative and support-oriented, ensuring the smooth flow of the appeal process.
  • All decisions regarding the appeal will be made by the review panel, which is independent of the Exclusion Appeals Coordinator's coordination efforts.
