Board of Cosmetology - Proposed Administrative Rules

The Board of Cosmetology (Board), under the Health Licensing Office (HLO), is notifying interested parties that proposed administrative rules have been filed with the Secretary of State's Office for publication in the May 2024 Oregon Bulletin. Permanent administrative rules are anticipated to become effective on July 1, 2024. 

HLO also filed statutory minor corrections for the Board's civil penalty schedules, which are available immediately on the Secretary of State's website and will be published in the June 2024 Oregon Bulletin

Administrative Rule Filings:

Summary of Proposed Rules do the Following:

  • Implements the requirements of SB 217 (2023), which include adopting required education and curriculum for barbering, esthetics, hair design, and nail technology and creating processes and procedures for approving a school's curriculum.
  • Creates a certification pathway for applicants who do not hold an authorization in Oregon but who have education or training in a field of practice that is substantially equivalent to Oregon's education or training, which is also required in SB 217 (2023). 
  • Adopts the definition of “natural physiological effects" in relation to “esthetics devices," which was inadvertently left out of the previous rule filing from implementing HB 2970 (2021), and aligns other rules with the definition of “esthetics device." 
  • Removes barriers for individuals retaking written examinations and eliminates requiring the Oregon Laws and Rules Examination for freelance authorization applicants and for individuals renewing their freelance authorization. 
  • Adds a requirement that practitioners attest to having current bloodborne pathogen trainings at the time of renewal.
  • Implements a $45 written examination fee for natural hair care applicants. 
  • Reorganizes rules to appropriate divisions and provides for general housekeeping changes.

A public rule hearing has been scheduled for May 22, 2024, from 10 a.m. to 12 p.m. (noon). Interested parties may attend the hearing inperson at the address listed above or through MS Teams.
