Tribal Consultation

Tribal Consultation upholds and honors Tribal sovereignty, strengthens the Oregon Department of Human Services (ODHS) government-to-government relationship with Tribal Governments, and promotes effective communication with the Nine Federally Recognized Tribes of Oregon.

Background

ODHS began developing a Tribal consultation policy with the Nine Federally Recognized Tribes of Oregon in 2022. 

At the request of Tribal governmental leaders for a single, comprehensive policy for ODHS and the Oregon Health Authority (OHA), the agencies identified changes needed to incorporate ODHS into the existing OHA policy. The OHA/ODHS Tribal Consultation and Urban Indian Health Program Confer Policy was adopted and ODHS began implementation on January 1, 2024.

Tribal consultation is a formal process agreed to by the Tribes, ODHS and OHA for regular and meaningful collaboration in the initiation of program development, program implementation and policy changes impacting Tribes. It upholds and honors Tribal sovereignty, strengthens agency government-to-government relations with Tribal governments and establishes minimum standard procedures.

Tribal consultation law

In 2001, Senate Bill 770 established a framework for communication between state agencies and federally recognized Tribes in Oregon. The following statutes further define these requirements:

  • ORS 182.162: Definitions
  • ORS 182.164: State agencies to develop and implement policy on relationship with Tribes
  • ORS 182.166: Training of state agency managers and employees who communicate with Tribes
  • ORS 182.168: No right of action created by ORS 182.162 to ORS 182.168
