Rulemaking for Oregon's Renewable Portfolio Standard (RPS) will help the state achieve 50 percent renewable power by 2040.
The Oregon Department of Energy submitted final rules to the Secretary of State on December 20, 2017 for the Renewable Portfolio Standard Program, implementing Senate Bill 1547 (2016). The permanent rules filing does not include any additional changes to rule language compared to the draft rules filed on October 25.This concludes the formal rulemaking process, which closed on November 29, 2017.

The proposed rule changes make permanent an existing temporary rule and add rule language to further clarify implementation of Oregon Laws 2016, chapter 28 (SB 1547). The proposed rule language extends the deadline by five months for stakeholders to apply for thermal renewable energy certificates (T-RECs) associated with qualifying thermal generation that occurred between the effective date of Oregon Laws 2016, chapter 28 (SB 1547), March 8, 2016, and the date that relevant Oregon Department of Energy (ODOE) rules were effective, December 21, 2016. The proposed rule also removes the requirement that generator representatives must be registered for thermal generation by the deadline.
Additionally, the proposed language aligns department rule with changes made to statute by Senate Bill 1547:
ODOE will accept oral testimony on the rules at the public hearing. Participants unable to attend may call in using the number listed above.

The public hearing will be the final opportunity for comment before the department files permanent rules. ODOE plans for the proposed rules to be effective on or before December 31, 2017.

The Oregon Department of Energy has released an initial draft of updates and changes to the administrative rules for Oregon’s Renewable Portfolio Standard (RPS) associated with the passage of SB 1547 (2016). The draft includes the temporary rule language filed in July to extend the deadline for applying for thermal renewable energy certificates (T-RECs) for stranded thermal generation.
Future Opportunities to Participate
Stakeholders may provide informal comments on the draft rules to the department between now and October 20, 2017.
ODOE will publish proposed rules in November 2017. A formal public comment period will follow, along with a public hearing planned for late November. This will be the final opportunity for comment before the department files final rules in December.

The scope of this rulemaking will include:

With the temporary rule, the deadline for applications is now January 1, 2018.
ODOE announced today its intention to file a temporary rule to extend the deadline for generator representatives to apply for thermal renewable energy certificates (T-RECs) for stranded thermal energy generated between March 8 and December 21, 2016.
Current ODOE administrative rules require that generator representatives must register a facility for thermal generation in WREGIS and must submit an application for certification as Oregon RPS-eligible to ODOE by August 1, 2017 to be eligible for T-RECs for stranded thermal generation. However, given delays in full functionality of thermal facility registration in WREGIS and changes to and refinement of the process of applying for Oregon RPS certification, ODOE does not find the August 1, 2017 to be attainable for most generator representatives.

You are invited to join the Oregon Department of Energy for the public hearing for the proposed rulemaking to establish processes to issue renewable energy certificates for thermal energy from biomass-based electricity generation (T-RECs) to meet the requirements of SB 1547 (2016).
This public hearing will be an opportunity for all interested stakeholders to provide public comments on the proposed rules. Comments may also be submitted to the department in writing by 5pm on November 2, 2016. This will be the final opportunity for comment before the department files final rules in late November of 2016.
