What is Advertising?

Advertising helps you connect with consumers. But it must also conform to Oregon Administrative Rules (OARs).

OAR 863-015-0125(1) and 863-025-0125(1) define advertising and advertisement as all forms of meaningful communication by or on behalf of a licensee designed to attract the public to use the services related to professional real estate activity.

Examples include, but are not limited to:

    • Print, such as mail, publications, brochures, postcards, business cards, and stationery.
    • Lawn signs, displays, and billboards.
    • Mobile phone, texts, cold calls, and outgoing voicemail greetings.
    • Broadcast media, including radio, television, podcasts, and videos.
    • Electronic online media, including MLS, websites, email, social media, and mobile apps.

The evolution of technology will most likely lead to new forms of advertising. You should always refer to the definitions of “advertising" and “advertisement" found in rule to determine if your activity is covered by this rule.
