Nexus & Dangerousness Workgroup (2024- )

Purpose: Between 2019 and 2021, the Psychiatric Security Review Board (PSRB) engaged with a diverse group of stakeholders in a legislative workgroup to identify critical issues and propose enhancements to the PSRB system. This collaboration culminated in a comprehensive report published in December 2021, which highlighted significant concerns, including the absence of a statutory definition for "substantial danger to others."
One key recommendation was the formation of a smaller workgroup to delve deeper into the concept of "nexus"—the connection between an individual’s mental disorder and their potential danger to others. In March 2024, a Court of Appeals decision created circumstances that prompted the Board to adopt an administrative change defining dangerousness. However, this change raised concerns regarding the perceived removal of the nexus requirement. In response, the Board reaffirmed that the statutory requirements for nexus remain intact and committed to further clarifying this critical concept.
To address these complexities, the new workgroup will review relevant statutes, case law, and practical implications related to the definitions of dangerousness and nexus. The primary goal is to generate recommendations for legislative changes and administrative rules that enhance clarity and consistency in their application, benefiting both professionals in the field and the individuals we serve.

PSRB Legislative Workgroup (2019-2021)

Purpose:  This PSRB workgroup, convened by Senator Floyd Prozanski at the request of the PSRB following the 2019 legislative session, aimed to address concerns about the PSRB within the context of Oregon's forensic mental health system. Comprising members from the legislature, state agencies, advocacy organizations, the legal community, law enforcement, and the mental health sector, the group held over a dozen meetings in to identify issues and develop recommendations.
The resulting report provides background on the PSRB and outlines a range of problem areas and recommendations that extend beyond legislative changes, addressing administrative rules, court processes, interdisciplinary training, and best practices. It emphasizes the importance of collaboration among stakeholders to enhance communication and improve outcomes for individuals under PSRB jurisdiction while prioritizing public safety.

Extremely Dangerous Persons with Qualifying Mental Disorder (2024)

Purpose: The Psychiatric Security Review Board is undertaking a review and update of its Division 200 Administrative Rules, which govern those individuals committed to the Board pursuant to ORS 426.701-702 (Extremely Dangerous Persons with Qualifying Mental Disorder).
