Insurance Requirements

Interstate Carrier Insurance

Motor Carriers engaged in interstate for-hire and intrastate operations transporting hazardous materials by certain vehicles are required to comply with federal financial responsibility requirements. Please review Federal Motor Carrier Safety Administration Regulations for Minimum Levels of Financial Responsibility for Motor Carriers — Title 49, Part 387. Intrastate Carrier Insurance

Motor Carriers applying for Intrastate 1A Permit Authority (form 9745) are required to file proof of public liability and property damage insurance with CCD at the time the vehicle(s) are registered and enrolled in Oregon’s weight mile-tax program. Cargo insurance may also be required. Oregon’s minimum acceptable limit for Cargo insurance is $10,000, signed by the carrier’s insurer, and must be filed with CCD.
  • Oregon Law ORS 825.160, ORS 825.162 and Oregon Administrative Rule (OAR) 740-040-010 require a person to not operate as a motor carrier on Oregon public highways until the person has filed proof of public liability and property damage insurance with ODOT Commerce and Compliance Division (CCD). The filing must be received within 60 days of the vehicle(s) being registered and enrolled in Oregon’s weight mile-tax program. Motor carriers risk being suspended if insurance documents are not timely filed.
  • Oregon’s minimum acceptable amount is $750,000 per accident for auto liability combined single limit.

Oregon’s Insurance Filing Requirements

Insurance is required to promote public safety and ensure fiscal responsibility of high liability operations. Motor carriers must have the underwriting insurance company file a Form E or Form H certificate of insurance with CCD as proof of insurance. Forms E and H are insurance industry forms only and are not supplied by CCD. Filing of insurance with FMCSA for interstate operating authority meets Oregon intrastate filing requirement. 

Liability Insurance

  • Motor carriers who only operate in Oregon must have liability insurance.
  • Insurance agents need to file proof of liability with a Form E.

Cargo Insurance

  • Cargo insurance is needed when hauling loads for-hire that are subject to loss or damage during transportation.
  • Insurance agents need to file proof of Cargo minimum amount of $10,000 with a Form H.
