On December 18th, Governor Kotek issued Executive Order 24-31 mandating the use of project labor agreements on state construction contracts. You can find a copy of the order, along with an FAQ the Governor's Office released on January 10th clarifying its applicability to non-state projects, at the following link. State agencies must assess projects for submission to the Governor for consideration of an exemption.
To have an exemption request considered, agencies must fill out the form below. Before filling out the form, please note that a PLA is not required when:
- The project will be going out to bid prior to March 31, 2025.
- The project is primarily related to design or inspection.
- The project is for necessary emergency construction work, consists of minor alterations or repairs, or is maintenance necessary to preserve a public improvement. To determine whether the project meets the definition of a maintenance project or minor alteration, please refer to ORS279A.010(cc). The EO does not apply to procurements conducted under ORS279B.
- The project is of short duration.
- The project lacks operational complexity or involves only one craft or trade.
- The project does not exceed the 15% threshold for onsite labor costs.
