Pro Hac Vice
 
To make legal arguments or sign legal documents in Commission proceedings, an attorney must be in good standing with the Oregon State Bar, or affiliate with such an attorney and appear pro hac vice.
 
A motion to appear pro hac vice before the Commission must contain the following:
  • Certificate of compliance for pro hac vice admission, available on the Bar website and linked to through this website, which covers most of the UTCR 3.170(1) requirements;
  • Certificate of good standing from the jurisdiction in which the attorney is a member of the Bar; and
  • Certificate of insurance covering the attorney’s activities in this state and providing professional liability insurance substantially equivalent to the Oregon State Bar Professional Liability Fund Plan, which provides insurance for each individual attorney with no deductible. 
 
In addition, the applying attorney must associate with a member of the Bar ("local attorney") "who must participate meaningfully in the matter."  UTCR 3.170(1)(c).  Applications must be made on a case by case basis.  See UTCR 3.170(5).  Each application is good for one attorney per case per year.  See id.
 
No fee need be submitted. Additional guidance is provided by UTCR 3.170, also found on the Oregon state bar link, or by contacting the Hearings Division.
