| WTC vs EPA court case |
|
The Oregon Department of Agriculture (ODA) continues to be in direct contact with the United States Environmental Protection Agency (EPA) regarding the January 22, 2004, order by the United States District Court for the Western District of Washington. This order places additional restrictions on the use of certain pesticides along Oregon waterways identified as supporting coho salmon, chinook salmon, steelhead and Columbia River chum. These additional restrictions include ”buffer zones’.
EPA and ODA have created maps specific to each Oregon county that identify the waterways to be ”buffered." The basis for these maps is information from a federal database, known as ”Streamnet’, specifically named in the federal court order. ODA maps are in Adobe Acrobat PDF form by county and TRS. The EPA maps are interactive, allowing the user to click on the map to zoom in to a particular location. ODA has made the currently available maps as accurate as possible, given the source information and staff resources. We do however encourage you to consult EPA´s maps and streamnet to verify the buffer requirements for streams prior to making pesticide applications with listed active ingredients. Not all counties have impacted waterways for all four species. For example, apparently only Clatsop, Columbia and Multnomah Counties have waterways impacted due to the Columbia River chum. And, six counties have no waterways impacted under this federal court order.
