Scale user's responsibilities
Basic responsibilities
 
  • Scales and weighing devices used for commercial* weighing in Oregon must meet state standards** for design, readability, accuracy, and reliability.
  • A weighing device must be suitable for the service in which it is used in terms of weighing capacity, type of readout, tare and computing capability (if applicable), etc.
  • A scale in commercial use must be annually licensed with the Department by the owner or operator before use. The license fee is determined by the manufacturer´s rated capacity of the device.
  • The weighing system must have an active NTEP CC (National Type Evaluation Program Certificate of Confonformance). 

Operators responsibilities
  • A weighing device must be positioned so that its indications may be accurately read and the weighing operation may be observed from a "reasonable customer position".
  • As a user of weighing equipment, you are responsible for the accuracy of your scale at all times. This means seeing that the device is properly balanced at the starting or "no-load" position, deducting correct tare weights when applicable, reading correct totals, and maintaining the scale in an error-free condition.
  • All security seals must be intact.

  • * "Commercial" or "commercially used" means any application or use in connection with or related to transactions in which, in exchange for commodities received or services rendered, consideration is given in terms of currency, negotiable instruments, credit, merchandise or any other thing of value (ORS 618.010).
  • Note: As defined above, in addition to all buying or selling on a weight basis, a "commercial" weighing transaction includes any providing of services using weight as a factor (such as package handling, commodity or product processing, vehicle or load weighing) when a charge is assessed for the services or a fee is collected.
