Senate Bill 838 created Oregon's Renewable Portfolio Standard (RPS). The RPS requires all utilities and electricity service providers (ESSs) that serve an Oregon load to include electricity generated from qualifying renewable energy sources in their portfolio of power. The required percentage varies over time. All utilities and ESSs must include some renewably-generated electricity by the year 2025.
New Oregon Administrative Rules by the Oregon Department of Energy (ODOE) have been put in place to:
1) identify a mechanism to track, and report on, Renewable Energy Certificates (RECs) acquired and used by electric utilities and electricity service suppliers to meet RPS requirements; and
2) establish a date when the mechanism noted in item 1 takes effect.
ODOE staff reviewed the work of the Renewable Energy Working Group (REWG), reviewed the statute with legal counsel, and discussed implementation with Oregon Public Utility Commission staff. During the rulemaking process, a public workshop and formal public hearing were held. As a result:
- the Western Renewable Energy Generation Information System (WREGIS) was designated as the entity to track and report Renewable Energy Certificates (RECs); and
- January 1, 2007 was set as the effective start date for operation of Oregon's RPS tracking system.
A petition for judicial review was filed by the Industrial Customer of Northwest Utilities (ICNU) on March 31, 2008.
