About the Law  
Effective January 1, 2002, employers in Oregon set out to improve the health of their employees. How? Easy. By complying with Oregon's Smokefree Workplace Law, employers protect the health of their employees.
 
As of January 1, 2002, Oregon law ORS 433.835-433.990  requires with few exceptions that:
 
"an employer shall provide a place of employment that is free of tobacco smoke for all employees."  
 
A place of employment is "every enclosed area under the control of a public or private employer that employees frequent during the course of employment."
 
 
The Law  
 
  • The amendments to the Law (made during the 2001 Legislature) have now been codified into Oregon Revised Statutes. The statute is now available.  Oregon Indoor Clean Air Act, ORS 433.835 through 433.900.
