Joint statement regarding Darlene Walsh
The Oregon Department of Human Services (DHS) and Darlene Walsh have reached
a settlement.
DHS dismissed Ms. Walsh in December 2002. Ms. Walsh appealed this decision
to the state Employment Relations Board, whose administrative law judge issued
a proposed order in June 2003.
The proposed order said in part, "The removal from management service is affirmed.
The termination from classified service is set aside. The Department shall reinstate
Appellant to the classified service and shall make her whole."
As part of the settlement, and under employee rights in the collective bargaining
agreement, Ms. Walsh has accepted a non-management position as a Social Service
Specialist 2 at the DHS office in Gresham.
The department has agreed to reinstate Ms. Walsh's benefits and to pay back
salary. The department has also paid attorney fees and other expenses.
Under the settlement, Ms. Walsh agrees to drop any claims against DHS. This
will dismiss any further litigation and legal expenses by the parties.
