Request for criminal background check, FBI clearance, and
child abuse report for private adoption purposes

 

Out-of-State residents requesting these clearances to comply with the Adam Walsh Law and/or the Hague Convention.

 

Out-of-State residents finalizing adoption in Oregon
For adoptions filed in Oregon, the department may waive the home study requirement for some categories of adoption, such as relative adoption and step-parent adoption. But in order to consider the request for waiver of the home study, the subject individual(s) must submit to a criminal records check, FBI clearance, and a child abuse registry check.

  • These clearances must come from the state where the subjects — petitioner and/or other adults in the home — reside at the time of filing the adoption petition in Oregon.

Generally, the birth or legal parent retaining parental rights is exempted from these background checks.

 

Oregon residents finalizing in Oregon

  • Agency or Independent Adoption
    If the prospective adoptive parents are working with a licensed adoption agency for an agency adoptive placement or to complete a home study for independent (non-related) adoption, the Oregon adoption agency obtains the criminal history, FBI (nationwide), and child abuse clearances for the prospective adoptive parents(s) and for other adults in the home.
     
  • Step-parent or Relative Adoption
    If filing a step-parent or relative adoption petition, the prospective adoptive parents or their attorney must request directly the criminal background check from the Oregon State Police if the petitioners are Oregon residents. The request for criminal history background check form, with instructions written on the form, can be downloaded at http://dhsforms.hr.state.or.us/Forms/Served/CE0249g.pdf.
     
    However, the child protective service (cps) or child abuse check is conducted by the department (DHS), using its cps registry information database.
